The appeal by some local residents against the Optus Tower site at the Robe Football Oval has been dismissed.
A commissioner of the Environment, Resources and Development Court gave their reasons in a published 34-page judgement.
Robe Council chief executive James Holyman said this meant that following building assessment approval, the construction of the telecommunications tower can start as there were no further avenues of appeal.
“Therefore, following consultation between Optus and the Robe Sports and Recreation Association, Optus have advised the council the proposed start date for the Optus telecommunications tower is September 26,” he said.
“Optus have been advised that council’s preferred position is that construction does not occur during the peak visitor season.”
Optus will be paying a four-figure sum to the sporting body each year as a lease fee.
