Accused granted bail

AMount Gambier businessman has been granted home detention bail by Magistrate Koula Kossiavelos in the Mount Gambier Magistrates Court.


Vincent Vinci is accused of committing assault against his own spouse, aggravated stalking, dishonestly taking property without consent and preventing a person from attending as a witness.


On Tuesday SAPOL Police Prosecutor David Stiles said prosecution remained firmly opposed to the bail request stating that “the protection of the victim is the paramount consideration”.


“The accused actually went to the police station as well while she (the victim) was trying to give her statements and also in the police view blocked the car in,” he said.


“Home detention bail will not stop him from being able to contact the victim and make threats in relation to her protection.”


Magistrate Kossiavelos ordered a cash surety of $20,000 from Mr Vinci and $10,000 from his wife which she said was “one of the highest amounts that I have ordered”.


Mr Vinci’s bail conditions include complying with the conditions of the victim’s intervention order, electronic monitoring, being available by phone at any time, surrendering his passport and being amenable to drug and alcohol testing.


Mr Vinci assured Magistrate Kossiavelos he had “no intention” of breaching any of his bail conditions.


“I have no intention of breaking anything and I will not,” he said.


“We’re on the same page there and I hope that is the case because the responsibility of granting you bail is on my shoulders and if you do breach your bail and something untoward does happen to the victim then it is my decision that is going to be questioned,” Magistrate Kossiavelos said.


Mr Vinci was denied home detention bail at the same Mount Gambier address when it was put before Auxiliary Magistrate Teresa Anderson in the Mount Gambier Magistrates Court two weeks prior, with Magistrate Kossiavelos telling prosecution at the time that she was “not bound” by Auxiliary Magistrate Anderson’s decision.


Mr Vinci will reappear in court on February 17, 2025 for a charge determination hearing and preliminary briefing.
